I, am to inform that the additional information submitted by the State Govt letter dated 17.05.2022 has been examined in this office. Moreover, the State Govt in its letter dated 24.11.2021 has mentioned that the guideline 3.B of MoEF & CC shall be imposed and proposing penalty of20% NPV as per 3B. It may however be mentioned that action under 3B requires action under 3 B (iii) i.e. taking action against officials concerned for not being able to prevent use of forest land for nonforestry purpose without Govt of India prior approval. In view of the above, the State Govt is requested to submit the action on 3.B (iii) along with the chronology of events on the violation taken place, to this office at the earliest so as to enable this office for taking further necessary action.

The additional information in respect to this instant proposal submitted by the State Govt vide letter dated 15.06.2022 has been examined. It is to be noted that this office has specifically asked for action under para 3B (iii) of Ministry's letter No. 11-4212017-FCdated 29.01.2018 which states: "State government will initiate disciplinary action against the official concerned for not being able to prevent use of forest land for non-forestry purpose without prior approval of the

The information submitted by the State Govt vide letter dated 13.09.2022 has been examined in this office and it appears that the State Govt is unwilling/ incapable of taking action as per rules, which is not in tandem with laid down rules. It may be mentioned from the first EDS itself this office vide letter No. 3-TR B 066/2022-SHI/2397-98 dated 05.01.2022 has specifically requested for action to be taken as per rules 1 guidelines as the State Govt has itself recommended the proposal as per guidelines 3-B II (iii) which therefore is a case wherein violation happened after the FC proposal has been initiated.
