1FP/UP/IND/25304/20178-05/1993-FC Pt.1.Legal Status of the diverted forest land shall remain unchanged. 2. The non-forest land identified for raising Compensatory Afforestation shall be notified by the State Government as RF under section 4 or P.F under section 20 of the Forest Act, 1927 or under the relevant Section of the local Forest Act, if not already done. 3. The User Agency shall transfer online, the Net Present Value (NPV) of the forest land being diverted under this proposal, as per orders of Hon’ble Supreme Court of India dated 29.03.2008, 24.04.2008 & 09.05.2008 in Writ Petition (Civil) No. 202/1995 and the guidelines issued by this Ministry vide its letter No. 5-3/2007-FC dated 05.02.2009, The requisite fund shall be transferred through on line portal into Ad-hoc CAMPA account of the State Concerned. 4. The State Govt. ensure that the user agency shall pay the additional amount of NPV, if so determined, as per the final decision of the Hon’ble Supreme Court of India. 5. The User Agency shall pay NPV at the rate of 20 percent for each year since the violation of Forest (Conservation) Act, 1980 has commenced. User agency shall pay penalty for violation as per guidelines issued by the Ministry’s letter No. 11-42/2017-FC dt. 29.01.2018. The present proposal was under consideration for renewal of diversion of forestland for non forestry purpose under FCA 1980 but user agency preferred to use the land for non-forestry purpose without valid renewal. User agency shall pay penalty two times the NPV, if the amount is not paid in time bound manner the user agency shall also pay 12% simple interest on NPV from the date of issue of this clarification from MoEF & CC till the deposit is made. The penal NPV amount will be in addition to the normal NPVstipulations. It shall be deposited in Ad-hoc CAMPA account. Compliance of above stated condition along with other stipulated conditions in Stage-I approval shall be complied prior to Stage-II approval. 6. User Agency shall raise penal CA equivalent to the land utilized in violation of the provisions of the Forest (Conservation) Act, 1980. User agency shall pay penalty for violation as per guidelines issued by the Ministry’s letter No. 11-42/2017-FC dt. 29.01.2018. The present proposal was under consideration for renewal of diversion of forestland for non forestry purpose under FCA 1980 but user agency preferred to use the land for non-forestry purpose without valid renewal. User agency shall pay penalty two times the NPV, if the amount is not paid in time bound manner the user agency shall also pay 12% simple interest on NPV from the date of issue of this clarification from MoEF & CC till the deposit is made. The penal NPV amount will be in addition to the normal NPVstipulations. It shall be deposited in Ad-hoc CAMPA account. Period of diversion of the said forest land under this approval shall be for a period co-terminus with the period of the mining lease proposed to be granted under the Mines and Minerals (Development and Regulation) Act, 1957, as amended and the Rules framed there under. 8. Any fund received from the user agency under the project and deposited in the State Forest Department account, except the funds realized for re generation/demarcation of safety zone, shall be transferred through on line portal into Ad-hoc CAMPA account of the State concerned. 9. The User Agency shall obtain the Environment Clearance as per the provisions of the Environment (Protection) Act, 1986, if required. 10. No labour Camp shall be established on the forest land. 11. . The State Govt. ensure that the User Agency shall provide fuels preferably alternate fuel to the labourers and the staff working at the site so as to avoid any damage and pressure on the nearby forest area. 12. The State Govt. ensure that the boundary of the diverted forest land, mining lease shall be demarcated on ground at the project cost, by erecting four feet high reinforced cement concrete pillars, each inscribed with its serial number, distance from pillar to pillar and GPS-co-ordinates. 13. The State Govt. ensure that the layout plan of the mining plan/proposal shall not be changed without the prior approval of the Central Government. 14. The State Govt. ensure that the Forest land shall not be used for any purpose other than that specified in the proposal. 15. The State Govt. ensure that the forest land proposed to be diverted shall under no circumstances be transferred to any other agency, department or person without the prior approval of the Central Government. 16. The State Govt. ensure that no damage to the flora and fauna of the adjoining area shall be caused. 17. The State Govt. ensure that any tree felling shall be done only when it is unavoidable and that too under strict supervision of the State Forest Department. 18. The State Govt. ensure that the User Agency shall submit the annual self compliance report in respect of the above stated conditions to the State Government, concerned Regional Office and to this Ministry by the end of March every year. 19. The State Govt. ensure that any other condition that the concerned Regional Office of this Ministry may stipulate, from time to time, in the interest of conservation, protection and development of forest & wildlife. 20. The State Govt. ensure that the User Agency shall comply all the provisions of all Acts, Rules, Regulations, Guidelines and Hon’ble Court Orders pertaining to this project, if any, for the time being in force, as applicable to the project. 21. The user agency will abide by the applicable recommendations of the State Government. 22. The State Government shall complete settlement of rights in terms of the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006, if any, on the forest land to be diverted and submit the documentary evidence as prescribed by this Ministry in its letter No. 11-9/1998-FC(Pt.) dated 03.08.2009 read with 05.07.2013 in support thereof.1.There will be no change in status of diverted forestland as on today and in future as well. 2. In compliance of this condition, user agency has provided 57.5590 ha non-forest land in Village Purna & Pedh of Sonbhadra District (Kaimur Vanya Jeev Prabhag) on 06.10.1995 & 3.6758 ha in village: Anjani & Pindari of Tehsil-Dudhi, Dist. Sonbhadra in Renukoot Forest Divison on 30.05.1998 according to Govt. of India, MoEF, New Delhi letter No. 8-5/93-FC dated. 22.02.1999 & U.P. Govt. Order No. 2464/14-2-99-911/1992 dt. 21.06.1999. The non-forest land (3.6758 ha) provided in Renukoot Forest Division has been notified under Section 4 of Indian Forest Act, 1927. 3. In compliance of this point, user agency transfered online Rs. 3,83,32,985.00 (Rupees three crore eighty-three lacs thirty-two thousand nine hundred eighty-five only) by E. Challan in A/c. No. 15090121253042017258 on 11.09.2017 through IDBI Bank Renukoot falling under Eco Class-III Open Forest in lieu of 61.2348 ha forestland transferred as per Guideline of Govt. of India, MoEF, New Delhi & CCF/Nodal Officer, U.P. Govt. Lucknow letter No. 625/11-C-FC/UP/NID/25304/2017 dt. 31.08.2017. 4. The user agency hereby ensures that any additional amount of NPV, if so determined by Hon’ble Supreme Court of India and demanded by State Govt., they are ready to pay. 5. In compliance of this condition, user agency has provided a Bank Guarantee No. 0544BGR0029718 dt. 11.08.2017 valid up to 30.11.2018 for Rs. 6,13,32,776/- (Rupees Six Crores thirteen lacs thirty two thousand seven hundred seventy six only) issued by ICICI Bank, Kolkata as per decision taken in FAC meeting held on 25.04.2017 and in continuation of the same, Govt. of India, MoEF, New Delhi letter No. F No. -8-05/1993-FC (PT) dt. 24.07.2017. In compliance of this, User agency has deposited on line Rs. 7,66,65,970/- through RTGS/IBKLR92018062600073061/UTTAR PRADESH CAMPA dt. 26.06.2018. 6. In compliance of this ondition, user agency has provided a Bank Guarante No. 0544BGR0029718 dt. 11.08.2017 valid up to 30.11.2018 for Rs. 93,01,811/- ((Rupees Ninty Three lacs One thousand Eight hundred eleven only) issued by ICICI Bank, Kolkata as per decision taken in FAC meeting held on 25.04.2017 and in continuation of the same, Govt. of India, MoEF, New Delhi letter No. F No. -8-05/1993-FC (PT) dt. 24.07.2017. In compliance of this, User agency has deposited on line Rs. 7,66,65,970/- through RTGS/IBKLR92018062600073061/UTTAR PRADESH CAMPA dt. 26.06.2018. 7. In compliance of this condition, user agency have informed that no mining work is being done in transferred forest land and only ash generatd by its power plant is being stored. Thus, MMDR Act, 1957 is not applicable. 8. In compliance of this condition, user agency will pay any demanded amount in Ad-hoc CAMPA account of the State Government. 9. In compliance of this condition, user agency have got Environment Clearance for this project by the Govt. of India, MoEF, New Delhi vide their letter No. J 13012/148/2008-IA II (T) dt. 21.01.2013 (copy attached). 10. In compliance of this condition, it is informed by User Agency that neighter at present there is any labour camp established in this forest land nor will be established in future.11. In compliance of this condition, user agency has provided fuels etc. to labourers & staff in past and will be provided in future too if required. 12. In compliance of this condition, user agency got demarcated the transferred forestland by erecting four feet high reinforced cement concrete pillars each inscribed with its serial number, distance from pillar to pillar along with GPS location. This has been certified by concerned Range Officer, Anpara also. 13. In compliance of this condition, user agency states that no mining work is being done in transferred forest land and only ash generatd by its power plant is being stored. Thus, MMDR Act, 1957 is not applicable. Thus, approval is not required from Govt. of India.14. In compliance of this condition, user agency undetakes that this forestland will be used only for storage of ash generated by its power plant and in future too, this forestland will not be used for other purpose. 15. In compliance of this condition, user agency undetakes that neither this forestland has been transferred to other agency, department or person and nor in future too this will be transferred. 16. In compliance of this condition, user agency ensures that no damage will be done to the flora and fauna of the adjoining area. 17. In compliance of this condition, it is to be informed that felling of trees was done with permission of U.P. Van Nigam in 1999 and at present there is no any tree in the said land. 18. In compliance of this condition, user agency will send compliance report to the State Govt., Regional Office and to Govt. of India, MoEF & CC, New Delhi in the end of March each year. 19. In compliance of this condition, user agency has provided undertaking that all conditions will be met levied by Govt. of India MoEF & CC from time to time.20. In compliance of this condition, user agency has provided undertaking in connection with this forestland that all Rules, Regulations and directions issued by Hon’ble Court from time to time will be complied with. 21. In compliance of this condition, user agency has provided undertaking that all recommendations/conditions will be met levied by Govt. of India/State Government in future. 22. In compliance of this condition, user agency has provided FRA certificate issued by District Magistrate, Sonbhadra in prescribed proforma.
