vii.Afforestation will be carried out over 79.048 ha. Of blank area at the project cost. A detailed afforestation scheme of native tree species in this regard including phasing will be prepared in consultation with the state Forest Department and submitted to this Ministry within six months positively. A committee consisting of CF (Central), Regional Office, Bhopal, CF in the Nodal Office of the state Govt. and CF (Territorial) shall monitor the progress of this condition. The entire 147.758 ha area (68.710 ha. Already afforested and 79.048 ha. To be afforested) will be fenced at the cost of user agency and maintained as green area.
vii. NMDC has carried out afforestation over 79.048 Ha blank areas of Bailadila Deposit-14 ML through State Forest Department. The afforestation scheme prepared by NMDC and Forest Deptt, Dantewada is enclosed as Annexure-1. A certificate issued by DFO, Dantewada is enclosed as Annexure-2. The afforestation scheme is intimated to MoEF, New Delhi / RO, Bhopal and State Forest Deptt vide letter dated 2/6/2000 (Annexure-3). The entire area of 147.758 Ha is kept as green belt.

viii. Fencing, protection and regeneration of the safety zone area will be done at the project cost. Besides this afforestation over one and a half times of safety zone area in degraded forest elsewhere will be done at the project cost.
viii. NMDC has deposited an amount of Rs2,50,41,534/- on 7/5/99 with Forest Deptt, Dantewada for the above purpose. MoEFCC circular no: 11-125/2014-FC dated 27/5/2015 clarified that safety zone shall be kept within the mining lease boundary. Accordingly, safety zone fencing and plantation is being undertaken within 7.5m of ML boundary. In this connection, MoU was also signed between NMDC Ltd, Kirandul complex and CGRVVN Limited, Jagdalpur on 15/05/2017 for carrying out safety zone plantation and fencing work. Work is under progress.

ix. Demarcation of mining lease area will be done on the ground at project cost using four feet high reinforced cement concrete pillars with serial numbers, forward & back bearings and distance from pillar to pillar.
ix. NMDC has already carried out erection of 4 feet tall cement concrete pillars along the lease boundary. The DGPS coordinates of the same have been mentioned on the pillars along with serial number and distance from pillar to pillar.

x.The user agency will make arrangement for free supply of fuel wood preferably alternate energy source to labourers and staff working on the project site so as to avoid any pressure on the adjacent forest areas.
x. All the employees of NMDC are provided with electricity on subsidized rates. A Gas cooperative distribution agency has been established and is run by NMDC which aims to provide gas connections to employees and local people. A total of 3350 gas connections have been provided in Kirandul complex till date. Apart from above, NMDC along with NGO “Samayata Math”, distributed bio-stove to following villages in 2014-15: Lendra (78), Madadi (228), Penta (170), Kadampal (208), Cholnar (196), Kalepal (128).

xi. Reclamation of lease areas will be done concurrently in consultation with the State Forest Department at the cost of user agency.
xi The iron ore mines at Bailadila are being operated at top of hills where mining is done by knocking off benches with 12m bench height. The pits are formed after removing 90 to 100m height of the hills. As the ore is further extending up to 200 to 250m from the existing levels, all the working pits needs to be extended vertically as well as laterally. Because of which the reclamation couldn’t be done concurrently along with iron ore mining unlike as Bauxite and Coal Mining, where the mineralized zones are shallow. Moreover, due to increased mineable reserves based on exploration data, the mines shall be worked at further depths. As per the schemes approved by I.B.M., reclamation in Deposit-14 is to start from the year 2028. However, NMDC has paid penal compensatory Afforestation charges of Rs. 10,86,91,947/- on 16/7/16 over the degraded forest land equal in extent to the broken up area (199.195 Ha) in deposit -14, which was not reclaimed.

xii.The period of permission under the Forest (Conservation) Act, 1980 will be for 20 years co-terminus with lease under MMRD Act, 1957 and w.e.f. date of expiry of previous lease.
xii. Noted. As per M.M (D.R) Amendment Act, 2015 and MoEFCC circular number F. No:11-51/2015 dated 1.4.2015, in case of existing mining leases, the period of validity of approvals accorded under F.C. Act shall be extended, and shall be deemed to have been extended upto a period co-terminus with the period of mining lease in accordance with provisions of MMDR Act as amended subject to some conditions such as payment of NPV charges. As per condition no: (i) of MoEFCC letter darted 1/4/15, NMDC has deposited NPV amount of Rs.30,27,03,552/- through RTGS in CAMPA account. (Rs.1.11 Cr on 21/4/11 and Rs.29.15 Cr on 15/12/14).
