6	State secretary	REPLY	Regional Office	09/12/2024	The aforesaid User Agency is not an intentional violator as they got valid mining list under Rule 24(4) of Major Minerals Concession Rules, 1960 after the due compliance complied. Further, as advised by the Joint Inspection Team (JIT) the User Agency to apply for Forest Clearance under Section 2 of Forest Conservation Act, 1980, the User Agency has applied for the same and is now under process. Based on the facts as per the records in this office, the undersigned is of the considered opinion that there is no scope for imposing for penalty. Hence, it is requested to consider and the User Agency maybe exempted from the payment of penalty and to grant Forest Clearance for the said proposal.
