(ii) Compensatory afforestation will be carried out over 22.10Ha of Non forest land at the project cost and the area will be notified as PF/RF under Indian Forest Act, 1927. (iii) Fencing, protection, regeneration and maintenance of safety zone area of 23.265 Ha will be done at the project cost. Besides this, afforestation over one and half times of safety zone area in degraded forest land elsewhere will be done at the project cost.(iv) Demarcation of mining lease area will be done on the ground at project cost using four feet height reinforced cement concrete pillars with serial numbers, forward & back bearings and distance from pillar to pillar.(v) The Virgin/Fresh forest land (22.10Ha) approved above will not be mined & shall be developed/conserved by the project authorities as a green patch at their own cost.(vi) No felling of trees shall be done within the lease area unless it is really warranted for mining and such felling should be done with the prior permission and the conditions imposed by concerned DFO. (vii) The user agency will make arrangement for supply of fuel wood preferably alternate energy source to the labourers and staff working on the project site so as to avoid any pressure on the adjacent forest areas. (viii) The user agency will dispose off the unsystematic waste dumps and re-arrange them in the specifically earmarked dump yard in the benches with boulder wall fencing to prevent washing away of the waste dump. (ix) Reclamation of leased mined areas shall be done simultaneously in the renewal period as per approved reclamation plan and in time bound manner in consultation with the State Forest Department at the cost of user agency. The Progress of reclamation shall be assessed by the State Forest Department and Regional Office, Bhubaneswar periodically.(x) The enclosed environmental safeguards will be strictly adhered to by the lessee. (xi) The approval under Forest Conservation Act 1980 is subject to the clearance under the Environmental Protection Act, 1986. (xii) The mining lease shall be co-terminus with the lease under MMRD, Act 1957 subject to a maximum Of 20 years, w.e.f. 13.02.1997. (xiii) Any other condition that the State Government or the Chief Conservator of Forest (Central), Regional Office , Bhubaneswar may impose from time to time in the interest of afforestation and protection and improvement of flora & fauna of the area.1. The Legal status of forest land has not been changed. (ii) Land for compensatory Afforestation has been mutated in favour of State Forest Department in village Benidih, Tahesil Telkoi, in Bhuyan Juanga Piirth Range, Keonjhar district. An amount of Rs 3,09,555/- has been deposited vide DD no 671158 dt 06.08.1999 to DFO, Keonjhar. The said area has been declared as Benidihi Protected Forest vide notification no 24379 dated 19.11.2010 by State Forest & Environment Department.(iii) A sum of Rs 6,44,054/- has been deposited to the forest department vide Bank Draft No 671158 dated 06.08.1999 towards the cost of fencing, protection, regeneration and maintenance of the safety zone area over 23.265 Ha, for a sum of Rs 3,02,058/- as well as the afforestation over one and half times of safety zone area in degraded forest elsewhere for a sum of Rs 3,41,996/-. (iv) Demarcation of mining lease has already been done by erecting four feet height RCC Pillars at each station on the ground at the project cost. Each pillar has been inscribed with serial no, forward & backward bearing and distance from pillar to pillar. (v) 22.10Ha of virgin forest land is being conserved & maintained as green patches by the project authorities as stipulated in the said approval letter. However the said unbroken forest land over 22.10 Ha will be utilised for mining and allied activities as per the recent approval granted by MoEF,Government of India on dt.28.08.2014. (vi) Tree felling was conducted by OFDC within the broken up area after obtaining permission from DFO, Keonjhar vide his office memo no 3825, dated 22.08.2005. Prior permission from DFO shall be obtained in future also whenever before any tree felling within the mining lease is to be taken up. (vii) The User agency is providing coal briquette with chulla / oven to the workers (270) and cooking gas cylinder(LPG) to the staff (132) of the company at the project site as an alternative source of fuel at free of cost, thereby avoiding pressure on the adjoining forest area. (viii) The OB / waste material generated has been dumped at Dump D1, D2, D3 and D4 as per Approved Mining Scheme. These are suitably terraced having individual slice height of 10-12 m. Overall dump slope is being maintained at less than 280. Plantation is being done regularly to prevent wash out and these dumps are rehabilitated by plantation of different species like Sisoo, Gambhari, Chakunda,Akasia,Teak,Mahaneem, Subabool, Chhatim, Neem, Karanj etc. Out of four dumps, three dumps namely Dump D1, D2 and D3 are inactive and rehabilitated. The waste dumps are surrounded by retaining wall to prevent wash off from the waste dumps. (ix) Reclamation of the mined out area is being done as per approved mining plan at the cost of user agency. An area of 5.567 Ha of mined out area has been reclaimed and rehabilitated. Total 32.717 Ha dump area has been rehabilitated by native species and a total 1,47,231 saplings have been planted on reclaimed pits as well as on dumps for greenery development. (x) Environmental safeguards are being followed strictly by the user agency. (xi) Environmental clearance under Environmental Protection Act,1986 has been granted by MoEF, Government of India vide letter no-J-11015/130/2005 DAII(M) Dated 14.06.2005. (xii) The renewal of mining lease has been granted for 20years w.e.f. 13.02.1997. The lease period is valid up to 12.02.2017. (xii) (1). The Wild Life Conservation plan has been approved by PCCF (Wild life), odisha vide letter no 2739, dated 13.04.2010. A sum of Rs 200.00 Lakhs have been paid to the CAF vide D.D No 934326 dated 21.04.2010.(2) A sum of Rs 1,33,23,000/- has been paid on account of Regional Wild Life Management Plan vide D.D No 117820 dated 18.06.2009. (3) The lessee is providing fund for the payment of two nos of watchers to the DFO, Keonjhar every year for the protection of flora & Fauna of the area.
